AVIOTOOLS IS NOT A SAFETY-CRITICAL, CERTIFIED, APPROVED, OR GUARANTEED-ACCURATE AVIATION SYSTEM. IT MAY CONTAIN ERRORS, INCLUDING SERIOUS, MATERIAL, OR SAFETY-CRITICAL ERRORS. ANY OUTPUT GENERATED BY THE APP MAY BE INCORRECT, INCOMPLETE, OUTDATED, INCONSISTENT, MISLEADING, OR UNSUITABLE FOR THE INTENDED FLIGHT OR AIRCRAFT.

By downloading, installing, accessing, or using Aviotools (the “App”), you (the “User”) acknowledge that you have read, understood, and agreed to this Disclaimer in its entirety. If you do not understand, accept, or agree with any part of this Disclaimer, do not download, install, access, or use the App.

The App is intended only for users who understand the risks and limitations associated with aviation operations and who are capable of independently verifying all information, calculations, and operational decisions.

1. CRITICAL WARNING - THE APP MAY BE WRONG

Aviotools is a software. Software can fail. Software can contain bugs. Software can produce incorrect results.

Despite development efforts, testing, validation, or previous correct operation, the App may contain programming errors or bugs, mathematical or logical errors, incorrect formulas or assumptions, rounding or precision errors, unit-conversion errors, data-processing errors, display or user-interface errors, errors caused by future software updates or operating-system changes, errors caused by corrupted, incomplete, incompatible, imported, or legacy data, errors caused by unexpected combinations of inputs, errors affecting only particular aircraft, devices, software versions, or operating conditions, errors that are not immediately visible to the User, and serious, material, or safety-critical errors that could lead to completely incorrect results or recommendations.

The App may therefore produce an output that appears reasonable, plausible, internally consistent, or professionally presented while nevertheless being incorrect.

A result displayed by the App must never be considered proof that a calculation is correct.

A result displayed as being “within limits”, “safe”, “valid”, “recommended”, “favourable”, or otherwise acceptable may be wrong due to a software error, incorrect configuration, incorrect input data, an incorrect aircraft model, an incorrect envelope, an implementation defect, or any other cause.

Conversely, the App may also incorrectly indicate that a value is outside a limit or otherwise unsuitable.

The User expressly acknowledges and accepts that the App may contain errors that have not yet been discovered and may never have been identified before the User's particular use case.

No previous successful use of the App, no consistency with a previous result, no apparent absence of errors, and no testing performed by the developer constitutes a guarantee that the App will operate correctly in any future circumstance.

2. PURPOSE AND SCOPE - REFERENCE, PLANNING AND TRAINING TOOL ONLY

The App is provided solely as a reference, planning, organizational, and training aid for aviation-related activities.

The App is NOT a certified aviation device, a certified flight instrument, an approved navigation system, an approved source of aeronautical information, or an approved Electronic Flight Bag (EFB), unless separately and expressly approved for that purpose by the competent authority. It is not a replacement for the aircraft's approved instruments, systems, manuals, placards, procedures, or limitations, nor is it a replacement for the Pilot's Operating Handbook (POH), Aircraft Flight Manual (AFM), Pilot Operating Handbook Supplement, Minimum Equipment List, operating limitations, or any other approved documentation. It is also not a substitute for proper flight planning, aeronautical judgement, pilot training, regulatory compliance, or professional advice.

The App must never be used as the sole or primary basis for a flight-critical decision. This includes, without limitation, decisions concerning whether an aircraft may safely or legally depart, aircraft weight, centre of gravity, mass and balance, aircraft loading, fuel quantity or fuel requirements, fuel reserves, navigation, headings, tracks, wind correction, ground speed, flight time, climb or descent planning, runway selection, crosswind or tailwind assessment, density altitude, aircraft performance, emergency procedures, weather-related operational decisions, airspace, route, altitude, or frequency selection, or any other decision that may affect the safety or legality of a flight.

3. THE APP IS NOT GUARANTEED TO BE ACCURATE

All calculations, conversions, visualizations, graphs, checklist items, navigation logs, fuel calculations, and other outputs generated by the App are provided without any guarantee of accuracy.

The App may use mathematical models, assumptions, approximations, simplifications, rounding, standard atmospheric models, user-configured data, or other computational methods that may not accurately represent the characteristics, limitations, configuration, equipment, operating environment, or approved performance data of a specific aircraft.

The App may fail to account for aircraft-specific performance characteristics, aircraft modifications, installed equipment, supplements, loading limitations, unusable fuel, fuel density variations, fuel system configuration, actual aircraft weight, changes to the aircraft since the original documentation was published, environmental conditions, runway conditions, obstacles, pressure or temperature deviations, turbulence, icing, terrain, wind variation, human factors, regulatory requirements, or other operational variables.

The User must assume that any output may be incorrect unless independently verified against authoritative and applicable sources.

4. MASS & BALANCE - PARTICULARLY IMPORTANT WARNING

The Mass & Balance functionality is a planning and reference tool only.

An incorrect Mass & Balance calculation can result in an aircraft being operated outside its approved weight or centre-of-gravity limits and may contribute to loss of control, structural damage, reduced performance, an accident, serious injury, or death.

The User is solely responsible for ensuring, point by point, that the correct aircraft is selected, that the aircraft's actual and current approved empty weight and arm are used, that all arms, stations, weights, fuel quantities, fuel densities, maximum weights, and other values are correct, that the correct and current CG envelope or moment envelope has been entered, that all aircraft-specific supplements, modifications, limitations, and configuration changes are taken into account, and that the result has been independently verified using the applicable and current approved aircraft documentation and, where appropriate, an independent manual or electronic calculation.

A graphical indication that the aircraft is “inside” a CG envelope does not guarantee that the aircraft is actually within its approved operating envelope.

The App may display, calculate, interpolate, or interpret the envelope incorrectly. An incorrectly entered, imported, converted, scaled, or processed envelope may cause the App to produce a false indication that the aircraft is within approved limits.

The App must therefore never be the sole method used to determine whether an aircraft is correctly loaded or within approved weight and balance limitations.

5. CHECKLISTS - NOT A SUBSTITUTE FOR APPROVED PROCEDURES

Any checklist created, stored, imported, displayed, or exported through the App may contain omissions, transcription errors, incorrect actions, incorrect sequencing, outdated information, or aircraft-specific inaccuracies.

Checklist content must be independently verified by the User against the current and applicable aircraft documentation.

The presence of a checklist in the App does not mean that the checklist is approved, complete, correct, current, or appropriate for the selected aircraft or operating situation.

In all circumstances, the applicable approved aircraft procedures, emergency procedures, AFM/POH instructions, placards, limitations, and instructions from the competent authorities take precedence over any content displayed by the App.

In an emergency or abnormal situation, the App must not delay or interfere with the execution of approved procedures or the exercise of sound aeronautical judgement.

6. NAVIGATION, NAVLOG, WEATHER, FREQUENCIES AND FLIGHT PLANNING

Any navigation-related, route-planning, heading, wind, ground-speed, time, fuel, frequency, or flight-planning functionality is provided for reference and planning assistance only.

The User must independently verify all operationally relevant information using current and authoritative sources, including official aeronautical publications, current charts, AIP information, NOTAMs, meteorological information, official airport information, applicable airspace information, current frequencies, aircraft documentation, and all other sources required by applicable regulations and good aviation practice.

The App may contain no guarantee of real-time information and must not be assumed to contain current, complete, or authoritative aeronautical data.

Any frequency, airport information, route data, weather information, magnetic variation, navigation data, or other information entered or stored by the User may be outdated, incorrect, incomplete, or inappropriate for the intended operation.

7. USER-ENTERED AND IMPORTED DATA

Aviotools relies, in whole or in part, on information entered, configured, created, imported, exported, or otherwise provided by the User.

The App cannot guarantee that such data is correct.

Incorrect, incomplete, outdated, corrupted, improperly imported, incorrectly converted, or mistyped data may directly cause incorrect outputs. This may include aircraft weights, arms, stations, loading data, CG envelope points, moment envelope points, fuel capacity, fuel density, fuel quantity, wind, headings, magnetic variation, distances, altitudes, temperatures, pressure settings, performance values, fuel flow, reserve requirements, checklist content, frequencies, airport information, route information, and any other user-configurable value.

The User is solely responsible for verifying the correctness, completeness, currency, suitability, and aircraft-specific applicability of all data entered into or imported into the App.

The fact that the App accepts data without displaying an error does not mean that the data is valid or correct.

8. DATA LOSS, CORRUPTION AND SOFTWARE FAILURE

The App may malfunction, crash, freeze, close unexpectedly, fail to save data, fail to load data, display incorrect data, lose data, corrupt data, or become unavailable.

Data stored locally on the device, including aircraft configurations, checklists, navigation logs, frequencies, and other information, may be lost or altered as a result of software defects, device failure, operating-system updates, storage failure, user action, import/export errors, backup errors, synchronization issues, or other causes.

The User is responsible for maintaining independent backups of all information that may be important.

No data stored within the App should be considered the sole or authoritative copy of safety-critical or operational information.

9. NO EMERGENCY OR TIME-CRITICAL RELIANCE

The App must not be relied upon as an emergency system, emergency checklist authority, emergency navigation device, or time-critical decision-making system.

During an emergency, abnormal situation, system malfunction, or other time-critical event, the User must follow the applicable approved procedures, aircraft documentation, operational requirements, and instructions from air traffic control or other competent authorities.

The App must not delay, replace, or interfere with immediate actions required for the safe operation of the aircraft.

10. PILOT-IN-COMMAND AND USER RESPONSIBILITY

The Pilot-in-Command retains sole and final responsibility for the safe and lawful conduct of the flight and for all operational decisions.

Nothing displayed, calculated, suggested, stored, generated, or exported by the App transfers, reduces, limits, or replaces that responsibility.

The User is responsible for independently verifying all calculations, verifying all source data, using the current and applicable aircraft documentation, complying with all applicable laws, regulations, operating limitations, and procedures, exercising appropriate aeronautical judgement, determining whether the aircraft and flight are safe and legal, and deciding whether or not to rely on any information produced by the App.

The App does not make a flight safe, legal, or suitable.

The User must never interpret the use of the App as a substitute for pilot qualification, recurrent training, aircraft-specific knowledge, or proper pre-flight preparation.

11. NO WARRANTY

To the maximum extent permitted by applicable law, the App is provided “AS IS” and “AS AVAILABLE”, with all faults and without warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise.

Without limitation, the developer does not warrant that the App will be accurate, that calculations will be correct, that outputs will be complete, that the App will be free from bugs or defects, that errors will be detected or corrected, that the App will operate without interruption, that the App will remain compatible with future devices or operating systems, that data will not be lost or corrupted, that the App will be suitable for any particular aircraft, flight, operation, purpose, or regulatory requirement, or that use of the App will prevent or reduce the risk of an accident or other adverse event.

Any use of the App is undertaken voluntarily and at the User's own risk.

12. ASSUMPTION OF RISK

Aviation is an inherently hazardous activity.

The User understands and acknowledges that reliance on incorrect information, calculations, procedures, or software outputs may result in aircraft damage, property damage, financial loss, serious personal injury, or death.

By using the App, the User acknowledges that software errors may occur and that even a serious or safety-critical error may not be apparent before, during, or after use.

The User accepts responsibility for independently verifying all safety-critical information before acting upon it.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the developer, its owners, contributors, licensors, distributors, affiliates, and service providers shall not be liable for any claim, loss, damage, injury, expense, cost, or liability arising out of or relating to the use or inability to use the App, reliance on any output generated by the App, incorrect calculations, software bugs or defects, inaccurate, incomplete, corrupted, or outdated data, incorrect Mass & Balance results, incorrect fuel calculations, incorrect navigation or flight-planning calculations, incorrect checklist content, loss or corruption of data, device or software failure, interruption or unavailability of the App, or any decision made or action taken in reliance upon the App.

This limitation includes, to the maximum extent permitted by law, any direct, indirect, incidental, special, consequential, punitive, exemplary, economic, or other damages, including but not limited to aircraft damage, property damage, loss of use, loss of data, loss of income, financial loss, operational disruption, personal injury, or death.

This limitation applies even if the developer has been advised of the possibility of such damages and even if a particular remedy fails for its essential purpose.

Nothing in this Disclaimer excludes or limits any liability that cannot legally be excluded or limited under applicable law, including, where applicable, liability for death or personal injury caused by negligence where such liability cannot legally be excluded, fraud, fraudulent misrepresentation, or any other liability that applicable law prohibits from being excluded or limited.

14. INDEMNIFICATION

To the maximum extent permitted by applicable law, the User agrees to defend, indemnify, and hold harmless the developer and its affiliates, contributors, licensors, distributors, and service providers from and against claims, demands, actions, proceedings, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising out of or relating to the User's use or misuse of the App, reliance on information or calculations produced by the App, the User's failure to independently verify safety-critical information, incorrect or incomplete data entered or imported by the User, the User's violation of applicable laws, regulations, operating limitations, or procedures, or the User's breach of this Disclaimer.

15. NO APPROVAL OR CERTIFICATION

Unless explicitly stated otherwise in writing, Aviotools has not been certified, approved, validated, or endorsed by EASA, FAA, ENAC, or any other aviation authority.

The User must not assume that the App satisfies any regulatory requirement merely because it performs an aviation-related calculation or displays aviation-related information.

Responsibility for determining whether any tool, device, software application, calculation, or procedure may legally or operationally be used for a particular purpose rests with the User.

16. CHANGES, UPDATES AND MODIFICATIONS

The App and this Disclaimer may be modified, updated, corrected, expanded, restricted, or discontinued at any time.

An update may introduce new functionality, alter existing functionality, correct errors, or unintentionally introduce new errors.

The availability of a newer version does not guarantee that previous versions contained no errors, and the absence of an update does not imply that the App is error-free.

Continued use of the App after an updated Disclaimer becomes effective constitutes acceptance of the revised Disclaimer, to the extent permitted by applicable law.

17. GOVERNING LAW

This Disclaimer shall be governed by and interpreted in accordance with the laws of Italy, without prejudice to any mandatory consumer-protection rights or other mandatory legal protections applicable to the User under the laws of the User's country of residence or other applicable law.

18. SEVERABILITY

If any provision of this Disclaimer is held to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

19. ACKNOWLEDGEMENT AND ACCEPTANCE

By downloading, installing, accessing, or using Aviotools, the User expressly acknowledges and agrees, first, that the App may contain bugs, defects, errors, and serious or safety-critical inaccuracies; second, that the App may produce incorrect results even when the User has entered data that is correct; third, that the App may display results that appear reasonable or valid while being incorrect; fourth, that the App is not a certified or guaranteed-accurate aviation system; fifth, that no calculation, indication, graph, checklist, or output generated by the App should be accepted without independent verification where safety or legality may be affected; sixth, that the User must always refer to applicable official and approved documentation and authoritative sources; seventh, that the Pilot-in-Command remains solely responsible for all operational and safety-related decisions; and eighth, that use of the App is entirely at the User's own risk, subject always to rights and protections that cannot legally be waived or excluded.

FINAL SAFETY WARNING

DO NOT USE AVIOTOOLS AS YOUR ONLY SOURCE OF INFORMATION FOR ANY FLIGHT-CRITICAL DECISION.

ALWAYS INDEPENDENTLY VERIFY ALL CALCULATIONS, WEIGHTS, ARMS, CENTRE-OF-GRAVITY LIMITS, FUEL REQUIREMENTS, PERFORMANCE DATA, NAVIGATION INFORMATION, WEATHER, NOTAMS, FREQUENCIES, CHECKLISTS, AND OTHER OPERATIONAL INFORMATION USING CURRENT, APPLICABLE, AND AUTHORITATIVE SOURCES. THE APP MAY BE WRONG. THE APP MAY BE SERIOUSLY WRONG. AN ERROR MAY NOT BE OBVIOUS. IF THERE IS ANY DOUBT ABOUT THE CORRECTNESS OF AN OUTPUT, DO NOT RELY ON IT. WHEN SAFETY, AIRWORTHINESS, LEGALITY, OR HUMAN LIFE MAY BE AFFECTED, OFFICIAL AND APPROVED SOURCES, APPLICABLE PROCEDURES, AND SOUND AERONAUTICAL JUDGEMENT MUST ALWAYS PREVAIL OVER ANY OUTPUT GENERATED BY AVIOTOOLS.
